EU AI Act Article 50: what it means for your AI phone agent from August 2026

What does Article 50 actually require?

Its transparency obligation is short and it is the part that matters for a phone agent: people must be informed that they are interacting with an AI system, unless that is obvious from the context. The transparency provisions apply from 2 August 2026.

For an AI receptionist this is not a difficult standard to meet. It means the agent says it is an AI, clearly, at the start of the interaction — not in a privacy policy, not on the website, and not after the caller has spent two minutes assuming otherwise.

Do I need to do anything before August 2026?

If your agent already discloses, no. Every agent we build opens by saying it is an AI on every call and in its first message on every channel, so the date arrives and nothing changes.

If you are buying an agent now from someone who treats disclosure as a configurable option, you are buying a rebuild with a deadline attached. It is worth asking the question before you sign rather than in July 2026.

Does this apply to WhatsApp and chat as well as calls?

Yes. The obligation is about a person interacting with an AI system, not about the channel it arrives on. A WhatsApp agent that replies without saying what it is has the same problem as a voice agent that does.

In practice this is easier on text than on voice, because the disclosure can sit in the first message and stay visible in the thread rather than being said once and forgotten.

What about calling people rather than answering them?

That is a separate set of rules and a stricter one. Outbound marketing calls in Italy have to be checked against the Registro Pubblico delle Opposizioni, and the consent requirements are meaningful.

We do not build outbound cold-callers in any market, so this does not come up for our clients — but if you are evaluating vendors, an agent that will dial a purchased list is carrying a risk that the transparency rules are the smallest part of.
